1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed via our online shop.

2. Contractual Partner, Formation of Contract

The purchase contract is concluded with Horl Corporation. Confirmation of receipt of your order is issued together with the acceptance of the order immediately after sending via an automated email. The purchase contract is concluded with this email confirmation.

3. Contract Language, Storage of Contract Text

The language available for the conclusion of the contract is English. We store the contract text and send you the order data via email.

4. Delivery Conditions

Shipping costs are added to the stated product prices. Further details regarding the amount of shipping costs can be found in the offers. The purchase of our products in our online shops for commercial resale is prohibited. If, despite technical precautions on our part, a violation is detected, we reserve the right to block the corresponding person(s) or institution(s) from our shops and cancel any outstanding orders. If you are interested in selling HORL products and would like to become a retail partner, please contact sales@horl.com.

5. Payment

The following payment methods are generally available in our shop:

PayPal: During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately thereafter.

Shopify Payments: We use the payment service provider Shopify Payments. Through this provider, we offer various integrated payment methods (including credit card, Apple Pay, Google Pay, Klarna pay later, and Sofort). Processing is carried out via Shopify International Limited, Ireland. After placing the order, you may be redirected to the website of the respective payment method provider to authorize the payment.

6. Retention of Title

The goods remain our property until full payment is made.

7. Transport Damage

If goods are delivered with obvious transport damage, please complain about such defects to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance.

8. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory liability for defects shall apply. Information on any additional guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online shop.

9. Liability

For claims based on damage caused by us, our legal representatives, or vicarious agents, we are always liable without limitation in the event of injury to life, body, or health, in the event of intentional or grossly negligent breach of duty, in the case of guarantee promises (if agreed), or insofar as the scope of the Product Liability Act is applicable. In the event of a breach of essential contractual obligations (cardinal obligations) through slight negligence by us, our legal representatives, or vicarious agents, liability is limited to the damage foreseeable at the time of conclusion of the contract. Otherwise, claims for damages are excluded.
